Terms of Service

1. Purpose

These Terms govern the rights, obligations, and responsibilities between the operator of SubV ("the Service") and its users ("Members").

2. Service Description

SubV ("the Service") provides real-time AI-powered subtitle translation for VTuber live streams on YouTube. The Service is available as:

• Chrome browser extension (PC)
• Android mobile application
• VOD (replay) subtitle access

3. Subscription and Billing

• The Service operates on a monthly subscription basis.
• Chrome extension subscriptions are managed through Patreon. Android app subscriptions are managed through Google Play. These are separate subscriptions.
• New users receive a 7-day free trial. No charges are incurred if canceled within the trial period.
• After the free trial, the subscription fee is automatically charged. To avoid charges, cancel before the trial period ends.
• Subscriptions can be canceled at any time through Patreon account settings or Google Play subscription management.
• Refunds are subject to the policies of the respective payment platform (Patreon or Google Play).

4. Acceptable Use

• The Service is for personal viewing assistance only.
• Subtitles provided through the Service may not be commercially used or redistributed.
• Users must not attempt to circumvent technical protections, reverse engineer, or gain unauthorized access to the Service.
• Account sharing between multiple users is prohibited.
• The Service is intended for users aged 14 and above. Users under 14 may not use the Service.
• The operator may suspend or terminate a user's account without prior notice for violation of these Terms. No refund shall be provided in such cases.

5. AI Translation Disclaimer

• The Service uses AI technology (speech recognition and machine translation) and does not guarantee 100% accuracy.
• Mistranslations, omissions, and delays may occur. The operator is not liable for damages resulting from such occurrences.
• Subtitles are provided for reference purposes only and are not official translations.
• AI speech recognition may generate text that differs from actual speech (AI hallucination). Subtitles should not be relied upon as an accurate transcript of what was said.

6. Intellectual Property

• The software, design, and technology of the Service are the intellectual property of the operator.
• Broadcast content copyrights belong to the respective VTubers and their agencies. The Service does not store or redistribute original video or audio content; it only processes audio in real time. However, translated subtitle text may be retained for a limited period to provide VOD subtitle access.
• VTuber names, logos, and characters are trademarks of their respective owners. Their display within the Service is for identification purposes only.

7. Service Modifications and Termination

• The operator may modify, suspend, or terminate all or part of the Service due to technical reasons, legal requirements, or operational needs.
• Users will be notified in advance of planned service interruptions, except in emergencies.
• The Service may be restricted due to policy changes by YouTube or VTuber agencies.

8. Limitation of Liability

• The Service is provided "AS IS" without warranties of fitness for a particular purpose.
• The operator is not liable for service interruptions caused by network failures, YouTube service changes, server outages, or other circumstances beyond its control.
• The operator's total aggregate liability arising from or related to the Service, whether direct, indirect, incidental, or consequential, shall not exceed the most recent month's subscription fee paid by the user.

9. Governing Law

• These Terms are governed by the laws of the Republic of Korea.
• Disputes should first be resolved through email communication (subvapp.contact@gmail.com). If resolution is not reached, disputes shall be subject to the jurisdiction of the courts of the Republic of Korea.

10. Changes to Terms

The operator may update these Terms. Changes will be communicated through in-service notices or email. Users who do not agree with the changes may cancel their subscriptions.

11. Privacy

The collection and use of personal information is governed by our Privacy Policy. By using the Service, you agree to the Privacy Policy.

12. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

13. Language

These Terms are provided in Korean and English. In the event of any conflict between the two versions, the Korean version shall prevail.
